
General Terms and Conditions for Room Reservations
1. Basic information
These General Terms and Conditions (GTC) govern the legal relationship between the guest/customer/organizer, hereinafter referred to as the guest, and the Bretterhotel, based in Hofstetten, hereinafter referred to as the hotel. For the sake of simplicity, these GTC always refer to a contract, regardless of the service in question. Only the hotel's terms and conditions valid at the time of conclusion of the contract shall apply. The guest's general terms and conditions shall only apply if this has been expressly agreed in writing prior to the signing of the contract. Should individual provisions of these GTC be ineffective or invalid, this shall not affect the validity of the contract and the remaining provisions of the GTC. In all other respects, the statutory provisions shall apply.
2. Place of jurisdiction / Applicable law
For any disputes arising from this contract, Interlaken shall be the place of jurisdiction, unless another place of jurisdiction is legally mandatory. Swiss law shall apply exclusively to all contracts, reservations, any additional agreements, and general terms and conditions. The place of performance and payment is the registered office of the hotel.
3. Contractual relationship / Scope
The contract for the rental of rooms, seminar rooms, areas and the purchase of other goods and services is concluded upon written confirmation by the guest. A reservation made on the day of arrival is binding upon acceptance by the hotel. Contract amendments only become binding for the hotel upon (written) reconfirmation. Unilateral amendments or additions to the contract by the guest are invalid. The subletting and re-letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior written consent of the hotel.
4. Period of use
Subject to other agreements, the guest has the right to use the rented rooms from 3:00 p.m. on the agreed arrival date until 11:00 a.m. on the departure date. In the event of unannounced, late departure from the room, the hotel reserves the right to remove the guest's belongings from the room and store them in a suitable place in the hotel at the guest's expense.
5. Options
Option dates are binding for both parties, subject to other contractual agreements. The hotel may dispose of the opted rooms/premises or services without further notice after the option period has expired unused. Confirmation must be received by the hotel by 6:00 p.m. on the last day of the option period at the latest.
6. Prices / Payment obligation
The prices communicated by the hotel are per night and in Swiss francs (CHF), including statutory value added tax and service. Visitor's tax and accommodation tax are charged separately and are based on the regulations governing visitor's tax in the municipality of Hofstetten and the regulations governing accommodation tax in the canton of Bern. The guest is obliged to pay the agreed or applicable hotel prices for the room and any other services used. This also applies to orders placed by their companions and visitors. Any increase in statutory charges after conclusion of the contract shall be borne by the guest. Prices quoted in foreign currencies are indicative and will be charged at the respective daily exchange rate. The prices confirmed by the hotel are valid. Prices may be changed by the hotel if the guest subsequently changes the number of rooms booked, the hotel services or the length of stay of the guests. In the event of an obvious incorrect booking due to system errors in the booking system, the agreed prices shall be void. In this case, the hotel has the right to cancel the booking without compensation. The hotel may request a credit card guarantee at any time. Deposits are required depending on the season and price type. The date and amount of the deposit can be found in the reservation confirmation. If the deposit is not paid or the credit card guarantee is not provided on time, the hotel may withdraw from the contract (including all service commitments) immediately (without reminder) and charge the cancellation fees listed in section 7 of these General Terms and Conditions. The hotel has the right to invoice the guest for its services at any time or to issue interim invoices. The final bill includes the agreed price plus any additional amounts incurred as a result of additional services provided by the hotel for the guest and/or accompanying persons. Unless otherwise agreed, the final bill must be paid in Swiss francs or by accepted credit card at the latest upon check-out on the day of departure. Cancellation of the reservation / Cancellation fees / Cancellation
Cancellation of the reservation requires the written consent of the hotel. If this is not given, the agreed price must be paid even if the guest does not make use of the contractual services. In the event of a no-show, 100% of the booked services will be charged. The date on which the hotel receives the guest's written cancellation is decisive for the calculation of the cancellation fee. This applies to both letters and e-mail messages. If the guest withdraws from the contract without an approved cancellation or if certain reserved services are changed or canceled, the hotel may charge the following cancellation fees.
Cancellation fees for individual reservations/group reservations: Cancellation fees vary depending on the season and price type; the applicable cancellation fees can be found in the written reservation confirmation.
8. Actions, use, and liability
a) Hotel
The hotel excludes liability towards the guest within the scope of the legal possibilities for slight and moderate negligence and is only liable for damage caused intentionally or through gross negligence. Should disruptions or defects occur in the hotel's services, the hotel will endeavor to remedy the situation immediately upon notification by the guest. If the guest fails to notify the hotel of a defect in good time, there is no entitlement to a reduction in the contractually agreed remuneration. The hotel is liable for guests' belongings in accordance with the statutory provisions, i.e. up to an amount of CHF 1,000.00. The hotel is not liable for slight or moderate negligence. If valuables (jewelry, etc.), cash, or securities are not handed over to the hotel for safekeeping, the hotel's liability is excluded within the scope of the legal possibilities. The hotel recommends that money and valuables be kept in the room safe.
b) Guest
The guest is liable to the hotel for all damage and loss caused by him, his companions or his assistants or event participants, without the hotel having to prove fault on the part of the guest. The guest is responsible for the correct use and proper return of all technical aids/equipment provided by the hotel or procured on its behalf by third parties, and is liable for damage and loss. c) Third party If a third party makes the booking for the guest, they are liable to the hotel as the ordering party together with the guest as joint and several debtors for all obligations arising from the contract. Irrespective of this, every ordering party is obliged to forward all booking-related information, in particular these general terms and conditions, to the guest.
9. Animals
Animals may only be brought into the hotel with the prior consent of the hotel and for a special fee. The fee per night is CHF 10.00 per night.
10. Smoking
Smoking is not permitted in the Trauffer Erlebniswelt or in the Bretterhotel, including all public areas and hotel rooms. Smoking is permitted in the outdoor area.
11. Lost property
11.1. Retention period
Lost property will be kept by the hotel for a period of two months. During this time, the hotel will attempt to find and notify the owners.
11.2. Whereabouts of lost property
a) Valuables (e.g., genuine jewelry, cell phones, laptops, high-quality headphones) will be handed over to the public lost property office in Brienz after the retention period has expired.
b) Other items may be donated to a charitable organization or disposed of after the retention period has expired.
11.3. No liability
The hotel accepts no liability for lost or forgotten items.
11.4. No transfer within the company
Lost property may not be passed on to employees or third parties.
General Terms and Conditions for Events
1. Scope
These general terms and conditions for events apply to Trauffer Erlebniswelt and Bretterhotel in Hofstetten in connection with the rental of seminar, banquet, and event facilities ("facilities") as well as related services or deliveries to and for the customer or event organizer. The subletting or re-letting of the premises or areas provided, as well as invitations to job interviews, sales or similar events, require the prior written consent of Trauffer Erlebniswelt.
The organizer's general terms and conditions do not apply.
2. Reservations
An offer to rent premises is explicitly designated as such and must be signed by the customer and returned to Erlebniswelt. The acceptance period defined in the offer applies in each case. This means in particular that offers, price lists, and similar documents issued by Erlebniswelt do not constitute a binding offer. Erlebniswelt expressly reserves the right to put the premises back on the market after the acceptance period for the offer has expired. In the event of a new inquiry, the new offer may differ from the first offer.
3. Prices
The prices confirmed in writing by Erlebniswelt apply. All prices are in Swiss francs, strictly net, including service and statutory value added tax.
4. Payment
Invoices from Bretterhotel and Trauffer Erlebniswelt without a due date are payable without deduction within 10 days of receipt of the invoice. Erlebniswelt is entitled to declare accrued claims due at any time and to demand immediate payment. Erlebniswelt is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer. If there are no separate advance payment terms, the following rules apply:
Advance payment of 50% of the services offered (hotel room, rent, minimum consumption, booked additional services, defined menu, etc.) up to 30 days before arrival.
If the organizer is based abroad, Erlebniswelt reserves the right to debit the entire invoice amount from the guarantee credit card or to demand payment in full before the event. Any exchange rate differences or bank charges shall be borne by the organizer. The customer may only offset an undisputed or legally binding claim against a claim by Erlebniswelt.
5. Joint and several liability for payment
If the client is not also the organizer, they shall be jointly and severally liable with the organizer for the entire invoice amount. This liability shall also apply in cases where direct payment has been expressly agreed.
6. Cancellation policy
Cancellations will only be accepted in writing. Erlebniswelt reserves the right to adjust the cancellation policy individually depending on the type and size of the event and to include this in the offer/reservation confirmation.
If no separate cancellation policy is available, the following rules apply:
Groups of 6 rooms or more:
Up to 30 days before arrival: free of charge
29–14 days before arrival: reduction of up to 50% of the booked service possible free of charge
From 13 days before arrival: 100% of the booked service will be charged
Groups of 15 rooms or more:
Up to 60 days before arrival: free of charge
59–22 days before arrival: reduction of up to 50% of the booked service possible free of charge
From 21 days before arrival: 100% of the booked service will be charged
If the actual number of people on the day of the event is lower, the definitively confirmed number will be used as the basis for billing. The additional costs incurred by the additional participants will be invoiced. The maximum room capacities specified by the fire department may not be exceeded.
7. Cancellation by the hotel
If an agreed advance payment is not made even after a reasonable grace period set by Erlebniswelt has expired, Erlebniswelt is entitled to withdraw from the contract.
Furthermore, Erlebniswelt is entitled to withdraw from the contract for objectively justified reasons, for example if
force majeure or other circumstances beyond the control of Erlebniswelt make it impossible to fulfill the contract
premises are booked under misleading or false statements of material facts, e.g., regarding the identity of the customer or the purpose of the booking
Erlebniswelt has reasonable grounds to believe that the use of the service may jeopardize the smooth operation of the business, the safety or the public reputation of Erlebniswelt, without this being attributable to the sphere of control or organization of Erlebniswelt
there is a violation of the above clause 4
there is a violation of section 8 below
In the event of justified withdrawal by Erlebniswelt, the customer shall not be entitled to claim damages.
8. Detailed information / Procedure
An appointment must be made in advance for detailed arrangements. In order to guarantee that the event runs smoothly, all important information (e.g., equipment, menu selection, schedule, show interludes, etc.) must be communicated to Erlebniswelt at least 14 days before the event. The agreed program times must be strictly adhered to by both parties.
9. Use of rooms
In exceptional cases, Erlebniswelt is entitled to make short-term room changes without notice during events. In any case, Erlebniswelt reserves the right to provide a room appropriate to the number of participants and the occasion if the number of participants is reduced. Outside the rented premises, reception tables, advertising material, banners, etc. may only be set up in consultation with Erlebniswelt. Public areas of Erlebniswelt may not be used for group work. This must take place in the agreed group rooms. Smoking is prohibited in all areas of Erlebniswelt.
10. Menu adjustments
Erlebniswelt reserves the right to make menu adjustments and vintage changes to wines.
11. Tapping fee
The organizer and their guests are generally not permitted to bring their own food and drinks to events. Exceptions require a written agreement with Erlebniswelt. If guests bring their own wines, spirits, cakes, etc., a corkage fee will be charged to cover overhead costs together with the total amount.
12. Decorations/flowers
The installation of decorations or other objects is subject to approval, including for fire safety reasons. Any damage caused during installation, etc., will be charged to the organizer.
13. Parking
Parking is normally available at the Ballenberg Open-Air Museum. Unless otherwise agreed, the organizer or individual participants are responsible for any parking fees incurred.
14. Technical equipment and connections
Insofar as Erlebniswelt procures technical and other equipment from third parties on behalf of the organizer, it acts on behalf of, with the authority of, and on account of the organizer. The organizer is responsible for careful handling and proper return. They indemnify Erlebniswelt against all third-party claims arising from the provision of these facilities.
The use of the organizer's own electrical equipment connected to the Erlebniswelt power grid requires the latter's written consent. Any malfunctions or damage to the technical equipment of Erlebniswelt caused by the use of this equipment shall be borne by the organizer, unless Erlebniswelt is responsible for them. Erlebniswelt may record and charge a flat rate for the electricity costs incurred through use.
With the consent of Erlebniswelt, the organizer is entitled to use its own telephone, fax, and data transmission equipment. The Erlebniswelt may charge a connection fee for this. If the connection of the organizer's own equipment means that equipment belonging to the Erlebniswelt remains unused, a compensation fee may be charged.
Malfunctions in technical or other equipment provided by the Erlebniswelt will be remedied immediately if possible. Payments cannot be withheld or reduced if the Erlebniswelt is not responsible for these malfunctions.
15. Fire safety regulations
The organizer undertakes to comply with the fire safety regulations of Erlebniswelt, in particular keeping escape routes clear, and guarantees that all materials brought in comply with fire safety guidelines. The use of flammable objects is strictly prohibited.
16. Delivery and collection of materials
Deliveries and collections for events must be coordinated with Erlebniswelt and communicated to Erlebniswelt in writing in good time, at least before their arrival. Erlebniswelt reserves the right to refuse shipments without a sender or valid addressee, including details of the event. Erlebniswelt accepts no obligation or liability arising from this. As Erlebniswelt's storage space is limited, Erlebniswelt may refuse to accept materials before the day of the event.
17. Musical entertainment, closing time, and night surcharge
For events with music, please note that music is only permitted at room volume after 10:00 p.m. DJs and bands are required to keep the bass low and cover the floor under the instruments with a carpet to dampen the sound. The maximum playing time is until 12:30 a.m. From 10:00 p.m., windows and doors must be kept closed and the volume of the music must be reduced. Guests who are outside are asked to behave quietly. The instructions of the Erlebniswelt staff must be followed. The organizer is liable for any complaints and fines.
From 10:00 p.m., a security guard will be on duty, who will be charged to the organizer at an hourly rate.
From 12:30 a.m., extension costs for each hour or part thereof are CHF 150.00.
18. Guest rooms
The "General Terms and Conditions for Room Reservations" apply to the booking of guest rooms. The following provisions apply in addition to or in deviation from these terms and conditions.
Breakfast is usually included in the room price. Any deviations will be communicated in writing.
For events involving overnight stays, the organizer must provide Erlebniswelt with a room list containing the following information about each guest at least 14 days before the hotel guests arrive: first and last names / address / telephone number / email address / arrival and departure dates / payment terms.
In the case of a block booking without a room list from the organizer, the hotel rooms must be booked directly by the guests and individually guaranteed with a valid credit card. After the deadline set by Erlebniswelt, the rooms still available in the respective block will be released for open sale. The organizer is liable in all cases for unpaid costs for rooms booked by their guests and their consumption (no-shows, minibar, etc.).
19. Liability / Duty of care
The premises and materials provided must be used with the utmost care by the guest. The organizer is liable for any damage to property or loss. Erlebniswelt accepts no liability for theft, damage, or services provided by third parties. This also applies to personal injury, unless caused by employees of Erlebniswelt. Erlebniswelt is liable within the scope of the statutory provisions.
